On July 23, 2019, the Trussville City Council approved the request from developer
Highpointe Properties for the property to be rezoned from residential to C2 commercial,
in a 3 to 2 majority vote. Voting in favor of the rezoning were council members Brian
Plant, Zachary Steele and Alan Taylor. Voting against the rezoning were council
members Jef Freeman and Perry Cook.
Now that the property has been rezoned to C2, Developer Highpointe Properties LLC
(principal Connor Farmer) is expected to purchase the Hamilton Property. Assuming
they do, they will need to submit final plans for subdivision of the area before the
Trussville Planning & Zoning Board.
This is where we will need to redirect our
efforts to make sure all restrictions and commitments agreed upon are adhered to
and carried out. There are a lot of moving parts for this development.
To the best of our knowledge, these are the proposals:
There is a .96 acre parcel of land currently owned by The City of Trussville, which will
be swapped for a larger 1.6 acre parcel on which a new Trussville City Board of
Education building will be constructed. (Lot 4)
As a concession to the city and residents, the developers agreed to gift to the City of
Trussville +/- 8 acres of property to be used as a city park. Developers have promised
to retain mature, old growth trees on the property as much as possible.
The developer will work with ALDOT to get a traffic signal to be synchronized with other
traffic lights on Highway 11.
There are currently 6 lots planned, all of which must adhere to the ordinances set out in
the Trussville Zoning plan for the Transition District, defined as “all property located on
or adjacent to both sides of United States Highway 11 lying generally between Mary
Taylor Road and Kay Avenue”. Those specifications can be found starting on page
101.2 of the
City of Trussville Zoning Ordinance.
LOT 1 - There are ZERO restrictions on this lot. Any type of business in the Trussville
Ordinance permitted under C2, C1, CP can be built there. You can find that list
here.
LOT 2 – A gas station and convenience store will be built here. The developers have
committed to match the architectural style to that of the Board of Education building.
LOT 3 – This parcel was rezoned with qualifiers. It is restricted from fast food
restaurants with a drive-thru with the exception of coffee shops, convenience stores,
auto repair, carwash, car/boat/motorcycle sales, or mini-warehouses and massage
parlor.
LOT 4 - Is designated for the new Board of Education building.
LOTS 5 & 6 - This parcel was rezoned C2 with qualifiers. It is restricted from auto
repair, car/boat/ATV/motorcycle sales, car wash, mini warehouse, massage parlor.
To quote Trussville resident Jean Cox, “Stay involved. Keep going to P&Z meetings.
Create change by staying actively involved in the community and volunteering when you
can. I hope that this issue has motivated many members of this group to create positive
changes in our community.”
